Legal Protection for Creators for Films Showing on Pirated Sites
Abstract
This study is entitled Legal Protection of Creators for Showing Films on Pirated Sites, which aims to understand and analyze the legal consequences of showing films on pirated sites and the second is the legal responsibility for showing films on pirated sites. The research method used in this study uses the Normative research method which is a library research, namely research on laws and regulations and literature related to the material discussed. Based on the results of the study, it can be concluded first: creators and copyright holders have exclusive rights, namely economic rights and moral rights. The act of showing films on pirated sites is to cause losses to the economic rights of creators and copyright holders who should receive economic benefits from a creation, and will have bad consequences for the perpetrators of piracy themselves such as legal prosecution, namely through civil or criminal channels such as compensation or other demands, and other consequences, namely the closure of the film provider site itself by the Ministry of Communication and Information. The second is the factors that cause film piracy, namely economic factors, social factors, technological factors, law enforcement factors, educational factors. Next is the responsibility of the perpetrators both civilly and criminally, responsibility through civil law is in 1365 of the Civil Code regarding unlawful acts and compensation, criminal responsibility is in Article 113 paragraph (3) and (4), and preventive efforts for the act of film piracy.
