The Authority of Local Governments in the Formation of Local Regulations with Religious Nuances
Abstract
This research aims to analyze local governments' authority in forming local regulations with religious nuances. This research uses normative legal methods with statutory, conceptual, and case approaches. The results show that the regional autonomy policy provides a wide space for local governments to regulate and develop their regions based on local potential and community aspirations. In the context of autonomy, local governments have full authority to form local regulations that regulate local government affairs, both in terms of substance and technical implementation. The establishment of religious local regulations becomes relevant when adjusted to the social conditions, culture, and characteristics of the local community. Therefore, public participation becomes an important aspect in the formulation process of local regulations, especially local regulations with nuances of Islamic law or other religions, to avoid conflict and reflect local values. However, the regional authority to form local regulations with religious nuances is still limited by the hierarchy of higher laws and regulations, so that testing the substance of local regulations with religious nuances must still refer to national legal norms.
