Abstract

This study aims to examine and understand the concepts of juridical possession and physical possession held by indigenous community members occupying communal land for which the Customary Village has registered a Right of Ownership , as well as the utilization of such land by individuals who are no longer “mipil”(officially registered) as members of the customary village. This research employs a normative research method. Possession of this land is not based on individual ownership rights but rather on the relationship of local people, manifested through the “mipil” registration system and the fulfillment of customary obligations “ngayah”. In the context of individuals who are no longer “mipil” or who have withdrawn from customary village membership, the right of possession over the communal land automatically reverts to the customary village.
