Legal Politics Regulating Wellness Tourism as Part of Health Services in Supporting Sustainable Tourism in Bali Province

Abstract

The development of wellness tourism as part of the transformation of quality tourism places the Province of Bali as the main destination for health-based tourism in Indonesia. However, the regulation of wellness tourism is still spread across various legal regimes, namely health law, tourism law, and regional policies, so it has not provided optimal legal certainty. This study aims to analyze the legal politics of regulating wellness tourism in the health legal system and assess its legal certainty for the implementation of wellness tourism in Bali Province. This study uses normative legal research methods with legislative, conceptual, and comparative approaches. The results of the study show that the central government and the Bali Provincial Government have directed policies to strengthen promotive health services, preventive, traditional health services, and quality tourism. However, the regulation is still sectoral, causing fragmentation of norms, not optimal synchronization of authority, and the absence of an integrated regulatory framework. This research offers a political and legal construction that integrates the health legal system and the tourism law system as the basis for regulating wellness tourism in order to realize legal certainty and increase the competitiveness of Bali as a wellness tourism destination.
