Reformulating Victim Assistance Norms for Sexual Violence Crimes Through a Victim-Oriented Approach
Abstract
This study aims to analyze the reformulation of the norms governing assistance for victims of sexual violence under Law Number 12 of 2022 on Sexual Violence Crimes, with a view to developing an ideal framework for realizing the victim-oriented approach. This study employs normative legal research using a statutory approach and a conceptual approach. The findings indicate that Article 26 paragraph (1) of the Law on Sexual Violence Crimes provides a normative basis for victim assistance but does not yet fully embody the victim-oriented approach. Accordingly, the norms governing assistance for victims of sexual violence should be reformulated to strengthen the victim-oriented approach by recognizing victim assistance as a fundamental right that must be guaranteed and facilitated from the earliest stage of case handling.
